Welcome to Yogprerna ("we," "us," "our"), accessible via Yogprerna.com (the "Website" or "Platform"). These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "Listing Owner," "Member") and Yogprerna. By accessing the Website, creating an account, or listing a property/profile, you agree to be bound by these Terms. If you do not agree, please cease use immediately. --- Directory Platform: Yogprerna acts as an online intermediary connecting users with yoga profiles, events, studios, colleges, online platforms, and employment opportunities. User-Controlled Modifications: The Platform grants registered listing/property owners the right to upload, modify, edit, and update their information directly. Institutional Partners: Specific organizations collaborating with Yogprerna may be subject to a separate Memorandum of Understanding (MoU). In the event of a conflict between these Terms and a signed/accept MoU, the terms of the MoU shall prevail for that specific partnership. Age Requirement: You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account. Account Accuracy: You agree to provide accurate, verifiable, and current information. You are entirely responsible for maintaining the confidentiality of your credentials. Unauthorized Access: You must immediately report any security breaches or unauthorized account usage to [email protected]. Content Ownership & License: You retain ownership of any text, video, images, certifications, or property data ("User Content") you upload. However, you grant Yogprerna a worldwide, royalty-free, perpetual, non-exclusive license to host, cache, display, modify (for formatting purposes), and distribute your content across our platform. Verification & Responsibility: Because you have the right to modify property and profile information, you assume full civil and criminal liability for the accuracy of that data. You warrant that you hold all necessary licenses, fire safety certificates, and professional qualifications displayed on your listing. Take-Down Rights: Yogprerna operates under "Safe Harbor" protocols. We reserve the absolute right, at our sole discretion and without prior notice, to edit, suspend, or permanently delete any listing that we deem fraudulent, inaccurate, out-of-date, or in violation of our Community Guidelines. You explicitly agree not to engage in: Scraping & Automation: Data mining, scraping, or using automated bots to extract directory profiles or phone numbers. Misrepresentation: Impersonating another yoga professional, institution, or falsifying certifications. Malicious Activity: Uploading malware, exploiting system vulnerabilities, or bypassing directory search parameters. 5. ARTIFICIAL INTELLIGENCE & INTELLECTUAL PROPERTY Proprietary Rights: The Yogprerna brand, code, UI design, databases, and our proprietary AI Wellness Partner ("Prerna") are the exclusive intellectual property of Yogprerna. AI Interaction: Interaction with our AI Wellness Partner is for informational and motivational purposes only. Replicating, scraping, or reverse-engineering the AI model output or logic is strictly prohibited. "As-Is" Clause: The Platform is provided on an "as-is" and "as-available" basis. Yogprerna does not verify the physical safety, legal compliance, or instructional quality of the listed properties or professionals. Third-Party Disputes: Any transaction, employment arrangement, or dispute occurring between a user and a listed property/studio is strictly bilateral. Yogprerna shall not be made a party to any such dispute. Damages Cap: To the maximum extent permitted under the Indian Information Technology Act and DPDP Act, Yogprerna shall not be liable for direct, indirect, or consequential damages resulting from platform downtime or reliance on incorrect user-modified data. Jurisdiction: These Terms are governed by the laws of India. Arbitration: Any dispute arising out of these Terms shall be settled through binding arbitration in Dehradun, Uttarakhand, in accordance with the Arbitration and Conciliation Act, 1996.
